Terms of Service

These terms are an agreement between you and Cognaby (“Cognaby”, “we”, “us”) for your use of the Cognaby website and app (the “Service”). By creating an account or using the Service, you agree to these terms. If you do not agree, please do not use the Service.
1. Who can use Cognaby
You must be at least 16 years old to create an account. By signing up you confirm that you meet this age requirement and that the information you give us (including your year of birth) is accurate.
2. Your account
We sign you in with a one-time code sent to your email, so there is no password. You are responsible for keeping access to your email secure, since anyone who can receive your code can access your account. Tell us at support@cognaby.com if you think your account has been used without your permission.
3. Your content
“Your content” means the notes, documents, photos and text you upload, anything you write in the app such as an explanation in your own words, and the decks and cards created from all of it. You keep ownership of your content. You grant us a limited licence to store and process it solely to provide the Service to you, which includes sending it to our AI processing providers to generate your cards, transcribe photos and scans, mark written answers you ask to have marked, rewrite a card you flag, and build warm-up questions. We keep the passages your cards were written from, so a card can show you where it came from, for as long as that deck exists. See our Privacy Policy for the detail. We do not sell your content or use it for advertising.
You are responsible for having the right to upload what you upload, and for not uploading anything unlawful, infringing, or that contains other people's personal data you have no right to share.
4. Acceptable use
You agree not to:
- break the law, infringe others' rights, or upload harmful or malicious content;
- attempt to disrupt, overload, reverse-engineer or gain unauthorised access to the Service;
- use automated means to scrape or abuse the Service, or attempt to bypass usage limits or security controls;
- resell or misrepresent the Service.
5. AI-generated study material
Cognaby uses AI to turn your material into study cards. AI can make mistakes, and generated cards may occasionally be inaccurate or incomplete. Study cards are a learning aid, not professional, medical, legal or academic advice. Always check anything important against your original source.
6. Classes
You are only in a class if you enter a join code yourself, and you can leave at any time from Settings. Joining lets the tutor who owns that class see your name, your account email, and your progress on the decks that class assigns to you, and nothing else about your account. Starting an assigned deck makes your own private copy of it.
If you run a class, you are responsible for having the right to share the material you assign and for how you use what the dashboard shows you. We may close a class that is used to distribute material the owner has no right to share.
7. Plans, payments and free features
Core studying and reviewing are free. Paid plans (when available) add higher limits and extra features. Prices, limits and plan details are shown in the app and may change; we will give reasonable notice of material changes. Payments, when introduced, are handled by our payment processor.
8. Availability and changes
We work to keep the Service available and reliable, but we provide it “as is” and cannot guarantee it will always be uninterrupted or error-free. We may add, change or remove features over time.
9. Ending your use
You can delete your account at any time from Settings, which erases your account and its data (see the Privacy Policy). We may suspend or end access if you seriously or repeatedly breach these terms, or where we must to comply with the law or protect the Service and its users.
10. Our liability
Nothing in these terms limits liability that cannot be limited by law. Subject to that, we are not liable for indirect or consequential loss, for lost data where you could reasonably have kept your own copy (you can export your data at any time), or for loss arising from AI output you relied on without checking your source.
11. Governing law
These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales, unless mandatory local law where you live says otherwise.
